1. Definitions

In these Terms and Conditions:

2. Acceptance of Terms

By submitting an enquiry form, enrolling in a course, or using any part of our website, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service.

You must be at least 18 years of age to enrol in any Mekhala Capital program. By enrolling, you confirm you meet this requirement and have the legal capacity to enter this Agreement.

3. Nature of the Service

Mekhala Capital provides financial education programs focused on insurance literacy, household protection planning, and later-life financial organisation. Our programs are educational in nature and do not constitute:

Nothing in our course materials should be interpreted as a recommendation to purchase, cancel, or modify any specific financial product. All product-related decisions should be made in consultation with a qualified, licensed professional.

4. Service Availability

Programs are delivered digitally in weekly modules. We make reasonable efforts to ensure materials are accessible at all times but do not warrant uninterrupted availability. Scheduled maintenance or unforeseen technical issues may cause temporary disruption.

Programs are available to learners in Thailand. Access from other countries is not restricted but may be subject to local laws or regulations that we cannot account for.

5. User Obligations

By using the Service, you agree to:

6. Intellectual Property

All course materials, documentation, frameworks, and content produced by Mekhala Capital remain our intellectual property. Upon enrolment, you are granted a limited, personal, non-transferable licence to use the materials for the duration of your program.

This licence does not permit reproduction, distribution, or commercial use of any materials. Unauthorised use may result in termination of access without refund.

7. Payment Terms

Course fees are listed in Thai Baht (THB) and are payable in full at enrolment unless otherwise agreed in writing. We accept payment by bank transfer and approved digital payment methods as confirmed at the time of enrolment.

Refund Policy: Requests for a full refund may be made within 7 calendar days of the enrolment date, provided that fewer than two course modules have been accessed. Refund requests after this period, or where more modules have been accessed, will be considered at our discretion but are not guaranteed. To request a refund, contact us at [email protected].

8. Course-Specific Terms

Our programs are self-paced with no mandatory completion deadline. There are no formal exams and no certification is awarded upon completion. The household protection folio produced in the 15-week program is a personal working document created by the learner and is not reviewed or endorsed by Mekhala Capital as a financial plan.

Optional mentor conversations in the 15-week program are educational in character. Mentors will not provide financial advice, insurance recommendations, or product referrals.

9. Disclaimers

The Service is provided "as is". While we make every reasonable effort to ensure the accuracy and currency of course materials, we do not warrant that all content is complete, current, or free of error. Thai insurance products, pricing, and regulations may change between curriculum review cycles.

We expressly disclaim any warranty that completion of our programs will lead to specific financial outcomes, savings, or protection improvements.

10. Limitation of Liability

To the fullest extent permitted by Thai law, Mekhala Capital's total liability for any claim arising from these Terms shall not exceed the course fee paid by you for the relevant program. We shall not be liable for indirect, incidental, or consequential damages of any kind, including financial losses arising from decisions made based on course materials.

11. Indemnification

You agree to indemnify and hold harmless Mekhala Capital, its team members, and associates from any claims, losses, or damages arising from your misuse of the Service, your breach of these Terms, or your violation of any applicable law.

12. Termination

We reserve the right to terminate or suspend access to the Service for any User who breaches these Terms, without prior notice and without refund. Users may discontinue their enrolment at any time; refunds in such cases are subject to the Refund Policy in Section 7.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising under these Terms shall first be addressed through good-faith correspondence between the parties. If unresolved within 30 days, disputes shall be referred to the jurisdiction of the courts of Bangkok, Thailand.

14. General Provisions

15. Changes to These Terms

We may revise these Terms periodically. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the revised Terms. Enrolled learners will be notified of material changes by email.
